General Terms and Conditions

Schladming Appartements Maria Gruber GmbH

The following terms and conditions regulate the contractual relationship made between the guest and the company Schladming Appartements Maria Gruber GmbH trading as "Schladming-Appartements". The guest accepts these conditions on behalf of every named member of the party when a reservation is being made.


1.    Reservation, contractual relations, costs and payment terms
You can make your reservation for any of our rental properties by telephone, e-mail in writing or online on our web www.schladming-appartements.at. You will receive written confirmation of your reservation by return.
The guest must pay 20% of the rental amount by bank transfer or credit card within 14 days of receiving the reservation confirmation. The remaining amount must be paid no later than 14 days before arrival by transfer / credit card or cash / credit card / bank card on the day of arrival. Your contract with Schladming-Appartements is concluded on receipt of the confirmation. If the reservation confirmation deviates from the description of the accommodation on the Schladming Apartments website, you acknowledge the conclusion of the contract based on the reservation confirmation with your deposit. If no deposit has been received within 14 days, Schladming-Appartements considers the reservation as void. For reservations made less than 14 days before the holiday start date the full rental amount must be paid in immediately. Costs include a handling charge made by Schladming-Appartements for every reservation.


2.    Services and Prices
The shown prices are in total for the booked stay and for the number of people specified in the reservation, including all additional costs such as final cleaning, linen package, summer card for the entire holiday property including furniture, normal energy consumption and utensils. Not included in the rental price and to be paid on the spot in cash / credit card / bank card are additional services requested by the guest such as additional cleaning, bed linen, pets, ski pass, bread service, etc.


3.    Changes in Price and Services
The rental properties are carefully described and the prices set accordingly. From time to time we have some variation in the prices or services may be necessary. In this case you will be informed immediately. If there are differences between details given on the website, the offer and the reservation confirmation, the agreements on the reservation confirmation apply. The correction of obvious errors, e.g. due to printing and calculation errors remains reserved. If significant changes in service (failure of booking-relevant facilities) occur after the contract has been occurred, you can withdraw from the contract free of charge within five days of receiving the notification. Payments already made will be refunded immediately. We expressly reserve the right to change prices up to 30 days before the start of the rental period for the following reasons: Increase or introduction of duties and taxes on certain services, change in exchange rates after the conclusion of the contract. If a price increase is more than 10%, you are entitled to the rights according to the above paragraph.
 

4.    Arrival and Departure, Curtailing or Prolonging your Stay, maximum occupancy
The guest is obliged to notify his arrival time which should take place between 3 and latest 6 p.m., the departure latest till 10 a.m. If your arrival is after 6 p.m., you must inform Schladming-Appartements and/or the landlord of the property directly in advance (the addresses and telephone numbers can be found on your reservation confirmation). Should you be delayed due to adverse traffic conditions, weather etc. and cannot take over the rental as agreed, we will still invoice the full amount for the rental. The same applies if you depart from the accommodation earlier than planned. Should you wish to extend your stay, please check with Schladming-Appartements in good time.
 

5.    Withdrawal from the contract by the tenant
A change / cancellation of the reservation can only be made in writing and is only valid if we have confirmed it in writing.

We guarantee a free cancellation of your booking up to 14 days before arrival and offer a "MONEY BACK GUARANTEE" in the event of your cancellation within the framework of the cancellation conditions.

After that we charge the following percentage cancellation fees:

  • From 13 days to 7 days before arrival: 70% of the total price
  • From 6 days before arrival or in the event of no-show: 90% of the total price

The receipt of your cancellation request at the booking office is decisive (on Sundays and public holidays, the next working day is decisive).

We recommend to take a holiday cancellation insurance.


6.    Alternative properties and cancellation of the contract by Schladming-Appartements
Schladming-Appartements is entitled to terminate the rental contract without further notice in the event of force majeure, war, strikes, and epidemics serious changes in circumstances relating to the property owner or other similar compelling reasons. In this case, any advanced payments will be refunded in full.
 

7.    Obligations of the guest
When the key is handed over, a deposit of about € 100 to € 500 (depending on the holiday property) must be made in cash or per credit card authorization (preferred). Up to 1 week after your departure - after deduction of any costs - the deposit will be refunded by bank transfer (only applies if the deposit was made in cash) or the credit card authorization will be cancelled / deleted. The rental property may only be occupied by the maximum number of people intended (this applies also to children and babies). Additional people can be refused admission by Schladming-Appartements or charged separately on spot. The rental property, all facilities and electronic and digital media must be used with care. Consideration should also be given to neighbours, etc. The guest holds Schladming-Appartement Maria Gruber GmbH completely indemnified and harmless. Cleaning of kitchen appliances, dishes etc. and cutlery is the responsibility of the guest (and is not included in final cleaning). If the guest or other occupants cause any damage, this must be reported to us immediately, whereby the written form is recommended. The guest is held liable for any damage caused by him or his fellow travellers as a result of improper use, etc. Damage caused that is not immediately visible in the sense of hidden defects can be reported by Schladming Appartements Maria Gruber GmbH to the guest up to 7 days after departure. Unless it can be proven that it’s not guest’s fault. The same applies if the apartment cannot be handed over to the next guest because of the damage. Damages can be offset against the deposit. Damages caused by the guest, which are not covered by the deposit, will be charged separately to the guest.

    
8.    Complaints, claims, liability of Schladming Appartements Maria Gruber GmbH
By complaints, please contact the landlord of the property or Schladming-Appartements directly. The defect must be reported immediately. We will not accept any claims made at a later date or after your departure. Information and descriptions provided by Schladming-Appartements are, to the best of its knowledge and belief, accurate, but no guarantee is given. Should the property not be as described in the contract, Schladming-Appartements will make every effort to provide you with an equivalent replacement property. If this is not possible within a short period of time, or if you reject this alternative property for objectively important and comprehensible reasons, Schladming-Appartements will at their discretion refund the equivalent of the reduced value.
We assume no liability towards the guest while they occupy the accommodation. In particular (but not exclusively), we assume no liability for damages that occur during the use of general parts of the house, such as pathways, ski rooms, sauna, pool, or similar facilities. There is no insurance of any kind for the guest or their property.
 

9.    Pets
Animals can only be brought into the vacation with prior agreement and confirmation from Schladming Appartements Maria GmbH and only against payment of € 15 per day and animal. The accommodation must be signed with pets allowed on our Homepage.
The guest who takes an animal with him is obligated to properly keep or supervise the animal during his stay or to have it kept or supervised by suitable third parties at his own expense.
The guest who takes an animal with him has to have an animal corresponding, liability insurance or a private liability insurance which also covers possible damages caused by animals.
Upon request, the guest has to provide a proof of corresponding insurance for the animal to Schladming Appartements Maria Gruber GmbH.
 

10.    Choice of law and place of jurisdiction
Any disputes arising from this contract between the client, agency and property owner will be settled before a competent court of law in Schladming, under Austrian law. The terms are subject to changes in price and to errors.
